Famous case whereby Franklin Roosevelt sought thereafter to pack the Supreme Court with New Deal
supporters.
The Schechter Poultry Corp. was charged and found guilty with 18 counts of violating the ‘Live
Poultry Code’ and 1 count of conspiracy. The ‘Live Poultry Code’ was promulgated under section 3
of the National Industrial Recovery Act. The U.S. Court of Appeals upheld most of the convictions.
The defendants argued that Congress could not regulate intrastate commerce.
The Supreme Court reversed the decision, effectively declaring the National Industrial Recovery Act
void, a blow to New Deal politics.
