Van Horne’s Lessee v. Dorrance, 2 U.S. (Dallas) 304 (1795)
 

A title dispute involving a territorial controversy between the states of Pennsylvania and Connecticut.

In this case, Judge William Paterson spent much time explaining and reminding the jury the relationship among the social compact, constitutions and legislatures; and particularly the relationship of natural rights, property ownership, and contracts. An exceptional insight into the times and mindset of the early nation.

Judge Paterson acknowledged that one of the primary purposes of the social compact was to protect property. That the phrase “social compact” was used instead of the phrase “political trust” is surprising. Nonetheless, the point stands that one of the primary purposes of government is to protect life, liberty, and property.
